ISSUE Whether the Applicant for joinder has an interest in the matter and is therefore entitled to be heard in the matter. FACTS: The Applicant Association applied by way of a motion on notice to the National Industrial Court praying, among other things, for an order of enforcement of its judgment in Suit No. NIC/5/93 delivered on 27th June, 1995 against the 1st to 4th Respondents. In the process of hearing the Applicant’s motion, but before the matter was adjourned for judgment, the Nigeria Civil Service Union applied to the court by way of a motion on notice dated l3tI February, 2005, pursuant to Rule 14 of the National Industrial Court Rules praying the court for an order to be joined as the 5t Respondent in the suit. The Union was the Appellant in Suit No.NIC/5/98, the judgment of which the Applicant sought to enforce. The court therefore, considered the application for joinder.
