style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">The Claimant brought this action vide a General Form Complaint dated the <b>6<sup>th</sup> day of April 2015</b> seeking the following reliefs:<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">1. <b>A Declaration</b> that the purported dismissal of the Claimant from the Nigeria Police Force whilst Charge No.MC. 427C/2010 between the Commissioner of Police versus Monday Sampson Akpan;Takon Orok;Ajang Kenneth and Augustine Sunday (Claimant) by the Commissioner of Police, Cross River State was still pending before the Chief Magistrate’s Court, Calabar, Cross River State constitutes a gross violation of the right of fair hearing of the Plaintiff as secured and entrenched by Section 36 subsections 1 & 2 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and therefore illegal, wrongful, unconscionable, null and void and without a fair hearing while a criminal case instituted by the Commissioner of Police, Cross River state was pending before the Chief Magistrate’s Court, Calabar in Charge No. MC. 472C/2010 without waiting for the conclusion of the criminal case constitute an infringements of the right of fair hearing of the Claimant as guaranteed by Section 36 subsections 1 & 2 of the Constitution of the Federal Republic of Nigeria, 1999 (as amended) and Article 7 (1) of the African Chapter on Human and Peoples Rights (Ratification & Enforcement) Act, 2010 and therefore illegal, wrongful, unconscionable, null and void and unconstitutional.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span neglect of the Defendant (including it agent or servant) to comply with the order of the Chief Magistrate’s Court, Calabar in Charge No. MC. 472C/2010 that the Plaintiff should be reinstated be re-instated to the Nigeria Police Force dated the 25th January 2012 is contemptuous, an affront, illegal, wrongful and unconstitutional.<o:p></o:p></span></p> <p class="MsoNormal" Mandatory Order</b> of this Honourable Court directing the Defendant to reinstate the Claimant into the Nigeria Police Force within 14 (fourteen) days of the delivery of Judgment in this the Claimant his salary, benefits and entitlements as a member of the Nigeria Police Force from October, 2010 till the date of delivery judgment in this case and from there until the Plaintiff is Payment of the sum of <b>N20 Million</b> as general/exemplary damages for the flagrant breach of the fundamental right of the Claimant and causing him great distress, hardship and discomfort.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">This Complaint was issued by CHIEF OKOI OFEM OBONO-OBLA OF OBONO, OBONO & ASSOCIATES (LEGAL PRACTITIONERS & CONSULTANTS) of Suite 071, Trinity House, Mabushi, Federal Capital Territory, Abuja, Nigeria, Legal Practitioners to the Claimant who resides in Nyanya, Federal Capital Territory Abuja, Nigeria.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><b><u><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif; mso-ascii-theme-font:minor-latin;mso-hansi-theme-font:minor-latin">STATEMENT OF FACTS<o:p></o:p></span></u></b></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">According to the Claimant, he was a Police Officer attached to the Calabar Free Trade Zone Police Division, Calabar, Cross River State of Nigeria, sequel to his enlistment into the Force on 1<sup>st</sup> March, 2008. He averred that he was 22 years old when he was enlisted and was supposed to have worked for 35 years, before retirement. However, he was dismissed by the defendant on the 18<sup>th</sup> June 2010 without a fair hearing. He was alleged to have been involved in a case of stealing and conspiracy and charged before the Chief Magistrate Court, Calabar. While the said charge was still pending before the Court, the Claimant was arraigned before what he referred to as a Kangaroo Orderly Room Trial on the offence of Breach of the regulations of the Nigeria Police Force, and was discharged. He was subsequently arraigned before another Orderly room Trial which later found the Claimant guilty even though the charge was still pending in Court. However on 25<sup>th</sup> January 2012, the Chief Magistrate dismissed the charge against the Claimant and ordered the Defendant to reinstate him, as he was already dismissed without waiting for the Court to pronounce the Claimant and convicting him. <o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">Despite the aforementioned Order the defendant refused to reinstate the Claimant to his employment.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><b><u><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif; mso-ascii-theme-font:minor-latin;mso-hansi-theme-font:minor-latin">DEFENCE<o:p></o:p></span></u></b></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">The Defendant did not file a Defence to this suit.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><b><u><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif; mso-ascii-theme-font:minor-latin;mso-hansi-theme-font:minor-latin">WRITTEN ADDRESSES<o:p></o:p></span></u></b></p> <p class="MsoNormal" style="text-align:justify"><b><u><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif; mso-ascii-theme-font:minor-latin;mso-hansi-theme-font:minor-latin">CLAIMANT<o:p></o:p></span></u></b></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">On behalf of the Claimant, counsel filed a Written Address wherein he submitted 2 issues for determination to wit:<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">1. <b>Whether</b> the Plaintiff has successfully proved his case.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">2. <b>Whether</b> the Plaintiff is entitled to all the reliefs sought in the complaint.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">While arguing issues 1 and 2 together, counsel submitted that civil suits are determined on the Preponderance of Evidence and balance of probability<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">He referred the Court to <b>section 134</b> of the <b>Evidence Act 2011</b>, and <b>ISEOGBEKUN AND ANOR VS ADELAKUN &ORS (2012) 3-4 MJSC</b>. He argued that the Burden of Proof is on the party in a case who will fail if no evidence is led in proof of facts alleged.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">He submitted that the Claimant has discharged the burden of proof required of him by the law as can be gleaned from the evidence adduced during trial and on the strength of the Authorities cited above. He contended that facts which remain undisputed as they were not challenged must be admitted and duly acted upon. He relied on the case of <b>OLOFU & 3ORS VS ITODO & 5ORS (2010) R S.C. (PT 1) P. 178, OBIEGUE VS A.G. FED (2014) 5NWLR (PT1399) 207.</b> Learned counsel further argued that the Principles governing the grant of Declaratory Reliefs generally include the following:<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">(a) A Declaration will be granted even when the relief has been rendered unnecessary by the lapse of time for the action to be tried, if at the time action was brought, it raised substantial issues of law;<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">(b) The claim to which the Declaratory Relief relates must be substantial, that is the Plaintiff/Claimant must be entitled to the relief in the fullest meaning of the word;<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">(c) A declaration will only be granted where there is a breach;<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">(d) The Plaintiff must establish a right in relation to which the declaration can be made hence the Court will not generally decide hypothetical questions;<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">(e) The relief claimed must be something which it would not be unlawful or unconstitutional or inequitable for the Court to grant;<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">(f) The relief should also not be contrary to the accepted principles upon which the Court exercises its jurisdiction.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">See <b>Chukwuma Vs. Shell Petroleum (1993) 4 NWLR (PT 289) 512 at 553.<o:p></o:p></b></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">On this counsel placed reliance on the case of <b>CHUKWUMA VS SPDC (1993) 4 NWLR (PT 289) 512 AT 553.<o:p></o:p></b></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">He submitted that the burden of establishing a case based on declaration rests more on the Plaintiff whose evidence must be credible, convincing, positive, affirmative and unequivocal in support of his case. Such evidence must be in accordance with his pleadings. He referred this Court to <b>AROWOLO VS OLOWOOKERE (2011) 11 – 12 S. C. (PT 11) 98 AT 107.<o:p></o:p></b></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">In the light of the above, Counsel urged this Court to enter Judgment in favour of the claimant based on the evidence adduced during trial.<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><b><u><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif; mso-ascii-theme-font:minor-latin;mso-hansi-theme-font:minor-latin">COURT<o:p></o:p></span></u></b></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">Having gone through the case of the Claimant and without any defence filed by the Defendants, I am however of the belief that the issue below if discussed will meet the Justice of this case to wit:<o:p></o:p></span></p> <p class="MsoNormal" style="text-align:justify"><b><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif; mso-ascii-theme-font:minor-latin;mso-hansi-theme-font:minor-latin">1) Whether the Claimant is entitled to the relief sought.<o:p></o:p></span></b></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin"> </span></p> <p class="MsoNormal" style="text-align:justify"><span lang="EN-US" style="font-size:14.0pt;font-family:"Calibri",sans-serif;mso-ascii-theme-font: minor-latin;mso-hansi-theme-font:minor-latin">It is trite learning that where evidence called by a party is unchallenged, the Court is at liberty to accept such evidence in proof of the issue in contest. However, the law in my view is settled that where evidence given by a party to any proceedings was not challenged by the opposite party who had the opportunity to do so, it is always open to the Court to act on the unchallenged evidence before it.
